You describe what sounds like a verbal contract, which is binding, like a written one (just harder to prove). Various states have different consumer protection laws. In Texas, for example, breach of contract allows taking the case to small claims court, and if the plaintiff wins he gets 3 times the value of the claim, plus court costs, if I recall precisely.
