Rob,
Sorry to hear how this fiasco has turned out so far. Ive been following this thread to see its result.
It is my opinion that to allow people to do this type of "business" without making them accountable in some way is wrong. Take for example the box itself as you described that the said items were mailed in. Duct tape and poorly packaged not to mention "beat up" which the ape's at our local PO have something to do with. Then the misc. lot of items, some of the items you wanted... Some junk... Some other stuff...
OK, This is one of those guys obviously whom clearly does less than the bare minimum to satisfy his end of the bargain. So his mother pressured him a bit, so like an ignorant self entitled slacker he vomited a box together for you just to shut the situation to a quick close.
Its manure heads like this that have ruined the spirit of Internet trading or commerce and turned into who can Hustle who first. I use the word "hustle" loosely as it is a theme here in the Los Angeles area. More specifically "West Hollywood."
Mulling over this issue to end is a tiresome and timely ordeal. The key is to make it as timely for him and also an ordeal. To allow another person to rip of buyers shouldnt be acceptable since it only opens the door to the next pin head who falls into the need to hustle a few bucks.
Fraud is fraud, logically He is still potentially guilty in some measure of fraud until he makes the order right.
Just my sixth sence.
