I retrieved the Bill of Sale below from the cars@xxxxxxxxxxxxxx web link
from yesterday's weekly report.  There is an interesting article about the
legalities of having a valid Bill of Sale when buying over the internet
which gives the purchaser and seller more legal rights in that it spells out
who pays what, and when, and what happens if something goes wrong.  I
thought it would be interesting for all see and read.  Perhaps Bryan Frank
or Pete Fitch could weigh in with their thoughts, or maybe this is enough to
get people to think about the commitments they are making with respect to
buying a car long distance.

 

I'm sure it isn't perfect, but it might be a start.

Deposit will be rendered by buyer within ___ days of the date of this

Seller agrees to fax a copy of the title to the buyer to verify that it is a
clear title. This will be done within two days of the signing of this
agreement.

 

Seller agrees to a vehicle inspection of the car. Vehicle inspection will be
done within ten days of this agreement. If the vehicle does not pass buyer's
inspection, buyer should notify the seller immediately. Seller will refund
any deposit rendered by the buyer within 10 days of notification that the
vehicle did not pass inspection.

 

Buyer agrees to pay ___________ (total price of vehicle minus deposit
amount) upon acceptance of the inspection results. (Either wire transfer or
other cash transfer of funds.)

 

Upon receipt and verification of the funds, the seller will send the signed
original title to the buyer via FedEx one day service.

 

The buyer must contract with a shipping company to pick up said vehicle.
Seller agrees to be available to sign the vehicle over to the shipping
company.

 

I DECLARE UNDER PENALTY OF PERJURY THAT THE STATEMENTS HEREIN CONTAINED ARE
TRUE AND CORRECT TO THE BEST OF MY KNOWLEDGE AND BELIEF.
